Terms of Service

Please read these Terms of Service ("Terms") carefully before using the HODL Dog browser game and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, connecting a wallet, or otherwise using the Service, you confirm that:

• You are at least 13 years of age (or the applicable minimum age in your jurisdiction).
• You have the legal capacity to enter into these Terms.
• You have read, understood and agree to be bound by these Terms and our Privacy Policy.
• If you are using the Service on behalf of an organisation, you have authority to bind that organisation to these Terms.

2. Description of the Service

HODL Dog is a browser-based pixel-art platform game in which players:

• Control a Doge astronaut character navigating levels, collecting in-game coins and avoiding obstacles.
• Optionally connect a Web3 wallet to access reward tracking features, leaderboard participation and in-game notifications.
• Participate in a points-based system where in-game actions may generate virtual reward credits within the game ecosystem.

The Service is provided "as is" and may be updated, modified or discontinued at any time without prior notice.

3. User Accounts and Wallet Connection

The Service does not require account registration to play. You may optionally connect a compatible Web3 wallet (such as MetaMask or Coinbase Wallet). By connecting a wallet, you:

• Authorise us to read your public wallet address for identification and leaderboard purposes.
• Confirm that you own or are authorised to use the connected wallet.
• Acknowledge that we do not have access to your private keys, recovery phrase or any funds.
• Accept full responsibility for maintaining the security of your wallet credentials.

4. Virtual Rewards and In-Game Economy

• In-game rewards are granted solely at our discretion and do not constitute a binding financial obligation.
• We reserve the right to modify, reduce or remove virtual rewards at any time.
• Virtual items cannot be transferred, sold or exchanged outside of the Service unless we explicitly enable such functionality.
• Accumulation of in-game rewards does not guarantee any future redemption or monetary value.
• Any future token distribution, airdrop or reward redemption mechanism will be subject to separate terms, legal compliance and applicable regulations at that time.

5. No Financial or Investment Advice

Nothing on the Service constitutes financial, investment, legal or tax advice. HODL Dog is a game for entertainment purposes. References to "DOGE", cryptocurrencies or blockchain technology within the game are thematic and do not constitute endorsement, promotion or advice regarding any actual cryptocurrency or investment.

Cryptocurrency markets are volatile and speculative. Any decisions regarding real cryptocurrency investments are made entirely at your own risk and are outside the scope of the Service.

6. Prohibited Conduct

You agree not to:

• Use automated scripts, bots, crawlers or exploit software to interact with the Service unfairly.
• Attempt to reverse-engineer, decompile, copy or reproduce the game's source code, artwork or mechanics for commercial purposes without written permission.
• Interfere with or disrupt the integrity or performance of the Service or servers.
• Attempt to gain unauthorised access to any part of the Service or its backend systems.
• Exploit bugs or vulnerabilities to gain unfair advantages; report these to us at [email protected] instead.
• Use the Service to transmit spam, malware or harmful content.
• Engage in any activity that violates applicable laws or regulations.
• Misrepresent your identity or affiliation with any entity.

Violation of these rules may result in immediate termination of your access to the Service.

7. Intellectual Property

All content on the Service, including but not limited to game code, graphics, artwork, animations, sound effects, music, text, logos and the HODL Dog name, is the intellectual property of HODL Dog Entertainment Ltd or its licensors, protected by applicable copyright, trademark and other laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial entertainment purposes only. This licence does not permit you to:

• Copy, modify, distribute or create derivative works of any part of the Service.
• Use any HODL Dog branding, trademarks or artwork for commercial purposes.
• Screen-scrape or systematically extract content from the Service.

User-generated content (if any) remains your property, but you grant us a worldwide, royalty-free licence to use, display and distribute it within the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

9. Third-Party Services and Links

The Service may integrate with third-party wallet providers and external links. We are not responsible for the content, privacy practices or terms of any third-party services. Your interactions with third parties are governed by their own terms and policies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, title or non-infringement.
• Warranties that the Service will be uninterrupted, error-free, secure or free of viruses.
• Warranties regarding the accuracy, reliability or completeness of any content.

We do not warrant that any defects will be corrected or that the Service will meet your requirements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HODL DOG ENTERTAINMENT LTD, ITS DIRECTORS, EMPLOYEES, PARTNERS AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, exemplary or punitive damages.
• Loss of profits, revenue, data, goodwill, or other intangible losses.
• Losses resulting from your use of or inability to use the Service.
• Losses resulting from any errors or omissions in any content on the Service.
• Losses resulting from unauthorised access to or alteration of your transmissions or data.
• Any loss or theft of cryptocurrency or digital assets from your wallet (which is entirely outside our control).

In jurisdictions that do not allow exclusion of implied warranties or limitation of liability for consequential damages, our liability is limited to the maximum extent permitted by law. In no event shall our total liability exceed SGD 100 (Singapore Dollars one hundred).

12. Indemnification

You agree to indemnify, defend and hold harmless HODL Dog Entertainment Ltd and its officers, directors, employees and agents from any claims, damages, losses, costs and expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms.
• Your violation of any applicable law or the rights of a third party.
• Any content you submit or transmit through the Service.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your licence to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination shall do so.

14. Changes to Terms

We may modify these Terms at any time. We will indicate the date of the most recent update at the top of this page. Material changes will be announced via a notice on the Service's homepage for at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be addressed through good-faith negotiations. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the Singapore courts, except where applicable consumer protection law requires otherwise.

If you are a consumer in the EU, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Severability

If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and any other policies posted on the Service, constitute the entire agreement between you and HODL Dog Entertainment Ltd regarding your use of the Service and supersede all prior agreements and understandings.
